Electronic Waste Authorisation

Under the Environment (Protection) Act, 1986, central and state governments are authorized to enact and take measures to safeguard the environment from hazardous waste being disposed of.

E-waste is a wide term containing home appliances (microwaves, fans, cookers), communication technology (mobile phones, laptops) office equipment (printers, WIFI dongal, landline phone) and the list goes on.

As E-waste is growing with the demand similarly becoming a problem to the world at large. Due to the toxic materials existing in electronic devices producing serious environmental health risks, it is important to be concerned about its careful disposal.     

To cure environmental health, Electronic waste management has come into the picture. It suggests recycling e-waste to treat the e-waste adequately.

Hence, all the persons including, manufacturers, dismantlers, recyclers, and refurbishers shall have to get e-waste certification.

Applicability of E-waste License

E-Waste Certificate will be required by every manufacturer, producer, consumer, bulk consumer, collection centers, dealers, e-retailer, refurbisher, dismantler, and recycler who is engaged in manufacturing, selling, transferring, purchasing, collecting, storing, and processing of e-waste or electrical and electrical equipment listed in Schedule 1 including their components or spare parts which make a product operational to use.

Excluding used lead batteries covered under the Batteries Management Rules, micro-enterprises defined under the Micro, Small and Medium Enterprises Development Act as well as radioactive waste covered under the Atomic Energy Act

Authorization Procedure under EWM

Authorization of Manufacturer

  1. Obtaining authorization from the concerned State Pollution Control Board comes primary set for getting e-waste registration
  2. Filing of application is required which if took place without a dpcc consultant appointed may lead to wrongful conduct leading to fine or closure of business.
  3. Inspection will be conducted by the officer and one being satisfied with requirements needed like appropriate facilities, technical capabilities, and equipment to handle e-waste safely, he will grant (within a period of one hundred and twenty days) an authorization in Form 1(bb). This authorization allows the applicant to carry out safe operations in the authority designated for five years.
  4. Annual Compliance:
  • Form 2: every person falling under this rule shall maintain records of e-waste handled by them.
  • Form 3: form for filing an annual return, the due date for the given form stands before 30th day of June of the following financial year.
  • Form 1(a): an application for the renewal of an authorization is made in this given form.

Authorization for grant of registration to Dismantler or recycler

  1. Obtaining authorization from the concerned State Pollution Control Board comes the primary set for getting e-waste authorization.
  2. Filing of Application is required which if took place without a dpcc consultant appointed may lead to wrongful conduct leading to fine or closure of business.
  • Form 4: Every dismantler or recycler shall make an application in the given form in triplicate to the concerned State Pollution Control Board along with: –
  1. Consent to establish granted by SPCB under Water and Air (Prevention)Control Act.
  2. Certificate of registration
  3. Proof of installed capacity of plant & machinery
  4. In case of renewal, certificate of compliance of effluent and emission standards, treatment and disposal of hazardous wastes as applicable from the concerned STCB.
  5. Inspection will be conducted by the officer and one being satisfied with requirements needed like appropriate facilities, technical capabilities, and equipment to handle e-waste safely, he will grant (within a period of one hundred and twenty days) an authorization. This authorization allows the applicant to carry out safe operations in the authority designated for five years.
  6. Annual Compliance:
  • Form 2: every dismantler and recycler shall maintain records in the given form.
  • Form 3: form for filing return with a due date on or before 30th day of June every year.
  • Form 4: to be filed for applying for renewal of the authorization.

Procedure for grant of E-waste certificate to Refurbisher                                             

  1. Obtaining authorization from the concerned State Pollution Control Board comes the primary set for getting e-waste authorization.
  2. Filing of Application is required which if took place without a dpcc consultant appointed may lead to wrongful conduct leading to fine or closure of business.
  • Form 1 (a): Every dismantler or recycler shall make an application in the given form in triplicate to the concerned State Pollution Control Board along with: –
  1. Consent to establish granted by SPCB under Water and Air (Prevention)Control Act.
  2. Certificate of registration
  3. Proof of installed capacity of plant & machinery
  4. Inspection will be conducted by the officer and one being satisfied with requirements needed like appropriate facilities, technical capabilities, and equipment to handle e-waste safely, he will grant (within a period of one hundred and twenty days) an authorization. This authorization allows the applicant to carry out safe operations in the authority designated for five years.
  5. Annual Compliance:
  • Form 2: is the form where refurbisher shall maintain records of the e-waste purchased and refurbished.
  • Form 3: form for filing an annual return to mentions activities of the previous year, on or before 30th day of June of every year.

Storage of E-Waste

Procedure for storage of e-waste shall be for a period of not exceeding one hundred and eighty days to be followed by every manufacturer, producer, bulk consumer, collection center, dealer, refurbisher, and recycler. Also, to maintain records regarding these transactions to make them available for inspection.

Concerned authorities may after discussion declare an extension of up to three hundred and sixty-five days in case the waste needs to be specifically stored for the development of a process for its recycling or reuse purpose.
