Applicability of Boi Medical Waste Management rules

As per Bio-Medical Waste Management Rules, 2016 all those persons who generate, collect, receive, store, transport, treat, dispose or handle bio-medical waste in any form including hospitals, nursing homes, clinics, dispensaries, veterinary institutions, animal houses, pathological laboratories, blood banks, Ayush hospitals, clinical establishments, research or educational institutions, health camps, medical or surgical camps, vaccination camps, blood donation, first aid rooms of schools, forensic laboratories and research labs.

BMW rules Not Applicable to:

  1. Radio-active waste covered under Atomic Energy Act, 1962
  2. Hazardous waste covered under manufacture, storage and import of Hazardous Chemical Rules, 1989
  3. Solid waste covered under Municipal solid waste (Management and Handling) Rules, 2000
  4. E-waste covered E-waste (Management and Handling) Rules, 2011
  5. Hazardous micro-organisms, genetically engineered micro-organisms and cells covered under the manufacturer, use, import, export, and storage of Hazardous Microorganisms, genetically engineered micro-organisms or cells Rules, 1989

List of necessary documents for DPCC registration

  1. Aadhaar Card of applicant
  2. PAN Card of entity
  3. DMC/ DBCP/ DMLT Registration
  4. Agreement with the operator of a facility transporter of the Bio-Medical Waste / Self-declaration in case bio-medical waste is not generated by the Health Care Facility (HCF).
  5. Noise Monitoring Report (if applicable)
  6. Undertaking duly signed by the applicant
  7. Project Report of HCF
  8. CA Certifying gross investment
  9. MAP of premises.

Procedure for Obtaining Pollution License for hospitals

STEP 1 : Drafting of Documents

STEP 2 : Consent to Establish

Consent to Establish has a validity period of one year which is a one-time process for which renewal is not required.

STEP 3 : Lab Testing Report

A lab testing report is necessary to analyze the parameters by the authorized laboratory of DPCC. It is done to check whether the installed Pollution Control Device is meeting the required norms or not.

Any doubts shall be dealt with the DPCC professional appointed by you.

 STEP 4: Inspection is conducted

Inspection shall be conducted by the prescribed authority to check whether all the compliances and requirements are fulfilled or not. In case of refusal or renewal, cancellation or suspension of the application, the reason shall be recorded in writing. Provided an opportunity of being heard is given to the applicant.

STEP 5: Consent to Operate

For operating a hospital, a mandatory certificate of Consent to Operate is to be taken to comply with the pollution provisions mentioned in the specified act.

STEP 6: Issuance of DPCC license for hospitals/clinics

As per category II(a), the activities/process which require installation of pollution control device for controlling pollution in emission/effluent in respect of: (a) SPIs/STPs of DJB, WTPs of DJB, CETPs/Power Plant/MSW Plants etc.  the issuance of certificate will be within 30 days from the date of receipt of the application by the deciding pollution authority.

As per category II(b), the activities/ process other than those falling under clause II(a), the issuance of certificate will be within 30 days from the date of receipt of application by the deciding authority.

DPCC Government fees for hospitals

As per Bio-Medical Waste Management Rules, 2016:

  • For Health Care Units run by Govt/ Govt bodies – Rs. 100/- per annum is required for Authorization under Bio-Medical Management Rules, 2016. Validity of both consent and authorization will be for a period of five years.
  • For Private Health Care Units
