Notice for revocation of DPCC Consent

Sub: Show Cause Notice for revocation of Consent under Air & Water Act

Whereas, you the above-mentioned addressee have submitted online application for Consent to Operate under Air & Water Act and engaged in activity of Plastic Waste Processing and Consent to Operate has been granted to you.

And whereas, the Ministry of Environment, Forest & Climate Change has notified Plastic Waste Management Rules, 2016 on March 27, 2016.

And whereas, every person recycling or processing waste or proposing to recycle or process plastic waste shall make an application to the State Pollution Control Board or the Pollution Control Committee, for grant of registration or renew of registration for the recycling unit, in Form II.

And whereas, in compliance with ‘Guideline on EPR for Plastic Packaging’ notified by Ministry of Environment Forest and Climate Change on 16.02.2022 in Schedule -II of PWM Rules, CPCB has developed a centralized EPR portal for Registration of Plastic Waste Processor including Recyclers.

And whereas, as per section 11.1 of the EPR guidelines, “All plastic waste processors shall have to register with concerned State Pollution Control Board or Pollution Control Committee in accordance with provision 13(3) of Plastic Waste Management Rules, 2016 on the centralized portal developed by Central Pollution Control Board. Central Pollution Control Board shall lay down uniform procedure for registration within three months of the publication of these guidelines.

And whereas, letters/emails have already been issued to you and for awareness and compliance of PWM Rules, DPCC has issued various Public Notices in leading newspapers.

In view of above and also CPCB letter dated 01.06.2022, 08.08.2022 & 17.08.2022, you are hereby directed that:-

1. You shall submit application with complete details ( as per the Standard Operating Procedure for Registration of PWP uploaded on EPR portal of your unit which is engaged in plastic waste processing on the Centralised EPR Portal (cpcbeprplastic.in) by August 30, 2022.

By way of this Notice, you are hereby also given an opportunity to Show Cause as to why you Consent to Operate under Air & Water shall not be revoked and also operation by your unit shall not be closed/stopped, for non-compliance of operating a unit without having valid registration under Plastic Waste Management Rules, 2016 which is a statutory requirement under the Environment Laws.

You are hereby again directed to apply for registration on the Centralized EPR Portal by August 30, 2022 and also submit the compliance report by August 31, 2022 to this office through email pwm.dpcc@delhi.gov.in.

Please note that operating a unit without having valid Registration is violation under PWM Rules, 2016 and in case of failure to comply the above, further action including disconnection of Power/water supply, closure of the unit, and imposition of Environmental Compensation, if any shall be initiated without any further reference in this regard to you.

This shall also be treated as an opportunity of being heard.
This is being issued as per the decision taken by the Competent Authority, DPCC.
